Copyright and Intellectual Property

All content published by Kawah Buku, including text, images, illustrations, and design elements, is protected by copyright under the Copyright Act 1987 (Malaysia). This includes both our own works and works by third parties licensed to us.

Fair Dealing

The Copyright Act 1987 (Malaysia) allows for “fair dealing” of copyrighted material for purposes such as private study, research, criticism, review, news reporting, and teaching (including incorporation into educational materials).

What is considered “fair dealing” depends on several factors:

• The purpose and character of the dealing: Is it for commercial gain or non-profit educational purposes?
• The nature of the copyrighted work: Is it factual or creative?
• The amount and substantiality of the portion used: Is it a small excerpt or a significant portion?
• The effect of the dealing upon the potential market for or value of the copyright work: Does it compete with the original work?

When Fair Dealing Might Apply

• Using a short excerpt from a Kawah Buku publication in a book review or research paper.
• Quoting a small portion of a text for educational purposes.
• Using a Kawah Buku book cover image in a library catalog listing.

When Fair Dealing Likely Does Not Apply

• Copying a significant portion of a Kawah Buku publication without permission.
• Creating derivative works (e.g., translations, adaptations) without permission.
• Uploading a full Kawah Buku publication or significant portions online without permission.

Obtaining Permissions

If your intended use falls outside the scope of fair use, you will need to obtain written permission from Kawah Buku. This applies to uses such as:

• Reprinting excerpts from our publications.
• Creating derivative works based on our publications (e.g., translations, adaptations).
• Using Kawah Buku content in online courses or educational materials.
